Major Hasan's Article 32 Hearing Officer sends recommendations to Special Court-Martial Convening Authority

FORT HOOD, Texas -- Prosecutors in United States vs. Maj. Nidal M. Hasan served Major Hasan's defense counsel the Article 32 Hearing Officer's report Nov. 17 containing findings and recommendations from the Article 32 hearing.

Colonel James Pohl found probable cause to support the 13 specifications of premeditated murder and 32 specifications of attempted premeditated murder alleged against Hasan. Colonel Pohl further recommended that the charges and specifications against Major Hasan be tried before a General Court-Martial. Colonel Pohl also found reasonable grounds to believe an aggravating factor exists to authorize capital punishment and recommended that a referral to a general court-martial be capital.

The Article 32 Hearing Officer's report serves as a non-binding recommendation to the officer that ordered the investigation. In this case, Colonel Pohl's report is to Col. Morgan Lamb, Special Court-Martial Convening Authority. Colonel Lamb is also awaiting results from a mental competency and responsibility board charged with evaluating the accused.

The Article 32 Investigation is one of several important steps in the deliberate legal process. An accused is presumed innocent until and unless proven guilty in a court-martial/court of law.
